Please read these Terms and Conditions (“Terms”) carefully before using our website, purchasing physical or digital products, or ordering author and publishing services. By accessing our site, registering an account, or placing an order, you agree to be legally bound by these Terms.

1. General Store Policies & User Accounts

By placing an order, you represent that you are at least 18 years old or are using the site with the consent and supervision of a parent or guardian.
You agree to provide accurate, current, and complete purchase, account, and contact information. You are responsible for maintaining the confidentiality of your account password.
Samak Press reserves the right to refuse service, terminate accounts, or cancel orders at our sole discretion if fraudulent, abusive, or unauthorized activity is detected.

2. Physical Products & Shipping

Processing Time: Physical products (paperbacks, hardcovers, merchandise) will be shipped within a minimum of 1 to 3 business days from the close of the day an order is processed. Shipping times vary depending on customer location and postal carrier schedules.
Shipping Rates: Shipping charges are automatically calculated at checkout based on the delivery address and chosen carrier method.
Damaged Shipments: Samak Press packages books and fragile merchandise in protective shipping materials. We will replace products that arrive with extensive defects or destruction. Minor cosmetic imperfections (such as slight corner bends or surface creases incurred during standard transit) are not eligible for refunds or exchanges. Please report severe shipping damage within 7 days of delivery with photos of the damaged packaging and book.

3. Digital Downloads & Electronic Media

Delivery: Customers purchasing an eBook receive a secure download link (ePub format) in their order confirmation email immediately following successful payment.
Refund Policy for Digital Goods: Because digital files cannot be retrieved or returned once transmitted to the customer, all eBook and digital download purchases are non-refundable.
License: Digital downloads are licensed solely for your personal, non-commercial reading use. Unauthorized copying, distribution, file-sharing, public uploading, or resale of Samak Press eBooks is strictly prohibited and constitutes copyright infringement.

4. Editorial, Writing & Publishing Services

Scheduling & Intake: Author services (proofreading, editing, book description writing, book ad writing) will be scheduled via email or follow-up communication within one business day following purchase. Completion timelines depend upon manuscript length, current queue volume, and the scope of service purchased.
Word Count Accuracy: Customers purchasing editing or proofreading services for a specific category (e.g., short story, novella, novel) must provide a manuscript within the stated word count parameters. Manuscripts exceeding specified parameters require payment of additional prorated fees prior to commencement of work. Failure to settle additional fees within 48 hours of notification may result in service cancellation without refund.
Editorial Refund Policy: Professional editorial and proofreading services require substantial labor and time commitments from Samak Press editors. As such, editorial services are strictly non-refundable. Refund requests stemming from subjective disagreement or dissatisfaction with professional editorial feedback will not be honored. Refunds will only be considered if Samak Press fails to deliver the service within the agreed timeline established in writing upon original purchase.
Revisions for Written Copy: Book description writing and ad copy services include one complimentary round of revisions based on initial feedback. Additional revision rounds beyond the initial review are subject to standard hourly copywriting rates.

5. Automated Author Services & “AS-IS” Advertising Disclaimers

Automated Strategic Intelligence: For automated products (such as the Amazon Ads Keyword & Strategy Audit), reports are compiled using algorithmic data analysis, competitive market extraction, and machine intelligence models based upon the author name, book titles, genres, and targeting hints supplied at checkout.
STRICT “AS-IS” & “NO WARRANTY” DISCLAIMER: ALL STRATEGY REPORTS, KEYWORD RECOMMENDATIONS, BID SUGGESTIONS, ADVERTISING FORMULAS, AND MARKETING TARGETS ARE PROVIDED STRICTLY ON AN “AS-IS,” “WITH ALL FAULTS,” AND “AS-AVAILABLE” BASIS. SAMAK PRESS AND ITS AUTHORS MAKE NO REPRESENTATIONS, WARRANTIES, OR GUARANTEES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR PROFITABILITY.
Third-Party Platform Disclaimers (Amazon.com): Amazon Advertising, Kindle Direct Publishing (KDP), Amazon A9/Cosmo search algorithms, ad auctions, category rankings, and Cost-Per-Click (CPC) rates are dynamic proprietary third-party platforms entirely beyond our control. Samak Press makes no representation that recommended keywords will achieve specific impressions, clicks, bestseller badges, or book sales. All advertising expenditures, bids submitted in Amazon Ad Console, and campaign management decisions are made at the customer’s sole and absolute risk.
Fulfillment & Retention: Automated reports are delivered electronically via email immediately following payment. Reports remain available for re-dispatch via secure retrieval codes for 180 days, subject to a maximum retrieval cap of 5 re-sends. Once report generation has commenced, all sales are strictly final and non-refundable.

6. Payments & Accepted Gateways

Payments on Samak Press are settled securely through approved merchant partners, including GoDaddy Payments, WooPayments, major credit/debit cards (Visa, MasterCard, American Express, Discover), digital wallets (Apple Pay, Google Pay), and flexible installment options (Klarna, Afterpay, Affirm). By submitting payment, you authorize our payment processors to charge the full order total.

7. Community Conduct, Comments & Reviews

Hate speech, harassment, defamation, profanity, and bullying in any form will not be tolerated on this site.
Users who post abusive or derogatory comments on blog posts, books, or store reviews will have their accounts immediately terminated and be permanently banned from the platform.

8. Intellectual Property Rights

All content published on this website—including book excerpts, cover art, text, graphics, logos, illustrations, audio clips, and software—is the exclusive intellectual property of Samak Press and its respective authors, protected by United States and international copyright laws. No material may be reproduced, modified, or distributed without prior written permission.

9. Limitation of Liability & Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MATERIALS, BOOKS, SOFTWARE, DIGITAL DELIVERABLES, AND SERVICES ON THIS WEBSITE ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. IN NO EVENT SHALL SAMAK PRESS, ITS OWNERS, DIRECTORS, AFFILIATES, AUTHORS, EDITORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, ADVERTISING LOSSES, GOODWILL, DATA, OR BUSINESS INTERRUPTION) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR INABILITY TO USE OUR WEBSITE OR SERVICES.

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF SAMAK PRESS ARISING FROM OR RELATING TO THESE TERMS, ANY ORDER, STRATEGY REPORT, DELIVERABLE, CONSULTATION, OR SERVICE EXCEED THE ACTUAL PURCHASE PRICE PAID BY THE CUSTOMER FOR THE SPECIFIC APPLICABLE REPORT GIVING RISE TO LIABILITY. ALL DAMAGES, REMEDIES, AND LIABILITIES UNDER ANY LEGAL THEORY (WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) ARE STRICTLY AND EXPRESSLY CAPPED AT THE FULL PURCHASE PRICE OF THE GIVEN REPORT.

10. Governing Law & Mandatory Binding Arbitration (State of Utah)

Governing Law: These Terms, the Privacy Policy, and all matters, disputes, or claims arising out of or related to our website, digital goods, or author services shall be governed by, construed, and enforced in accordance with the internal substantive laws of the State of Utah, United States of America, without giving effect to any choice or conflict of law principles that would cause the application of the laws of any other jurisdiction.

Mandatory Binding Arbitration: PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS. You and Samak Press mutually agree that any dispute, controversy, or claim arising out of or relating to these Terms, our Privacy Policy, your account, or the purchase, delivery, or use of any product or service from Samak Press shall be resolved exclusively by confidential, binding individual arbitration, rather than in court.

Arbitration proceedings shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect, before a single neutral arbitrator. The arbitration shall take place in Salt Lake County or Utah County, Utah, or may be conducted virtually/telephonically upon mutual agreement. Judgment upon the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

CLASS ACTION & JURY TRIAL WAIVER: YOU AND SAMAK PRESS AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF, CLASS REPRESENTATIVE, OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE PROCEEDING, OR REPRESENTATIVE LAWSUIT. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS. BOTH PARTIES VOLUNTARILY AND KNOWINGLY WAIVE ANY RIGHT TO A TRIAL BY JURY.
